Welcome to Joyride Pizza! These Terms and Conditions (“Terms”) govern your access to and use of the website joyridepizza.com (the “Site”), including any content, functionality, and services offered on or through the Site, such as online ordering for pickup and delivery.
These Terms are a legally binding contract between you (“you” or “user”) and Joyride Pizza (“we,” “us,” or “our”).
By accessing, browsing, or using the Site in any manner, including placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Site.
1. Eligibility

If you are between the ages of 13 and 18 (or the age of legal majority in your jurisdiction), you may only use the Site under the supervision of a parent or legal guardian who agrees to be bound by these Terms. By using this Site, you represent and warrant that you meet these requirements.

a. Menu, Pricing, and Availability: All menu items, descriptions, and prices are subject to change without notice. We strive to provide accurate information, but we do not warrant that product descriptions, pricing, or other content is accurate, complete, reliable, or error-free. All orders are subject to availability. We reserve the right to impose quantity limits on any order or to refuse service to any customer.
b. Order Acceptance and Cancellation: Your placement of an order does not necessarily mean that we will accept your order. We reserve the right to refuse or cancel any order for any reason, including but not limited to: product availability, errors in the description or price of the product, error in your order, or suspicion of fraud or an unauthorized or illegal transaction.
c. Payment: You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. You authorize us and our third-party payment processor to charge your selected payment method for the total amount of your order, including all applicable taxes and fees.
d. Refunds and Returns: All sales are considered final. If you are unsatisfied with your order due to an error on our part, please contact the Joyride Pizza location where your order was placed immediately. Refunds or credits are provided at our sole discretion.
e. Delivery and Pickup: Estimated times for delivery and pickup are provided as estimates only and are not guaranteed. The risk of loss for all items ordered by you passes to you upon our delivery to the carrier or upon your pickup of the items. We are not responsible for delays caused by third-party delivery services, traffic, weather, or other factors beyond our control.
4. Allergen Information
WARNING: Our kitchen facilities handle ingredients containing common food allergens, including but not limited to wheat, dairy, soy, nuts, and eggs. While we take steps to minimize the risk of cross-contamination, we cannot guarantee that any of our products are safe to consume for people with severe allergies. You are responsible for communicating any specific allergies when placing your order, but you acknowledge and accept the risk of potential cross-contamination.
5. Intellectual Property Rights
The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Joyride Pizza, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
The name "Joyride Pizza," our logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Joyride Pizza. You must not use such marks without our prior written permission.
6. Prohibited Uses
You may use the Site only for lawful purposes. You agree not to use the Site:
In any way that violates any applicable federal, state, local, or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the US or other countries).
To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.
To impersonate or attempt to impersonate Joyride Pizza, an employee, another user, or any other person or entity.
To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Site, or which, as determined by us, may harm Joyride Pizza or users of the Site or expose them to liability.
To scrape, data-mine, or use any robot or other automatic device, process, or means to access the Site for any purpose, including monitoring or copying any of the material on the Site.
7. Disclaimers
THE SITE, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER JOYRIDE PIZZA NOR ANY PERSON ASSOCIATED WITH JOYRIDE PIZZA MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SITE.
8. Limitation on Liability
TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL JOYRIDE PIZZA, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SITE, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE D1AMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM THE USE OF THE SITE OR OUR PRODUCTS IS LIMITED TO THE AMOUNT YOU PAID TO US FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.
9. Indemnification
You agree to defend, indemnify, and hold harmless Joyride Pizza, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site.
10. Governing Law and Dispute Resolution
a. Governing Law: All matters relating to the Site and these Terms shall be governed by and construed in accordance with the internal laws of the State of California without giving effect to any choice or conflict of law provision. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the federal courts of the United States or the courts of the State of California2, in each case located in the City and County of San Francisco.
b. Binding Arbitration: At our sole discretion, we may require you to submit any disputes arising from these Terms or use of the Site, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying California law.
c. Class Action Waiver: YOU AND JOYRIDE PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
11. California-Specific Provisions
a. California Consumer Privacy Act (CCPA/CPRA): If you are a California resident, you have certain rights regarding your personal information. Please review our Privacy Policy to understand these rights and how to exercise them.
b. 12. Miscellaneous
a. Entire Agreement: These Terms and our Privacy Policy constitute the sole and entire agreement between you and Joyride Pizza regarding the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.
b. Severability: If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
